1. Acceptance of Terms

By accessing or using the Tixbud platform, website, and mobile applications (collectively, the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the Platform.

Tixbud reserves the right to modify these Terms at any time. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

2. Definitions

• "Platform" means Tixbud's website, mobile applications, and all related services.
• "User" means any individual who accesses or uses the Platform, whether as a guest, registered user, or event attendee.
• "Organizer" means a user who creates and lists events on the Platform.
• "Attendee" means a user who purchases tickets to attend events.
• "Content" means all information, text, images, data, links, or other material posted on the Platform.
• "Tickets" means digital tickets purchased through the Platform for entry to events.

3. Account Registration

3.1 Account Creation

To access certain features of the Platform, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify Tixbud immediately of any unauthorized use of your account.

3.3 Account Types

• User Account: For attendees to discover and book events
• Organizer Account: For event creators to list and manage events

4. User Conduct

When using the Platform, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others, including intellectual property rights
• Post false, misleading, or fraudulent information
• Use the Platform to harass, abuse, or harm others
• Interfere with or disrupt the Platform's operation
• Attempt to gain unauthorized access to any part of the Platform
• Use automated means (bots, crawlers, scrapers) to access the Platform
• Create multiple accounts for fraudulent purposes
• Resell tickets at prices higher than face value (scalping)

5. Organizer Responsibilities

Event organizers using Tixbud agree to:

• Provide accurate and complete event information
• Ensure they have all necessary rights and permissions to host the event
• Comply with all applicable laws and regulations
• Honor all tickets purchased through the Platform
• Process refunds in accordance with their stated refund policy
• Communicate any event changes or cancellations promptly
• Assume full responsibility for the event's execution and safety
• Indemnify Tixbud against any claims arising from their events

6. Payments and Fees

6.1 Ticket Purchases

When you purchase tickets through Tixbud, you agree to pay the listed ticket price plus any applicable fees and taxes. All payments are processed securely through our payment partners.

6.2 Organizer Fees

Tixbud charges organizers a service fee for each ticket sold. The fee structure is disclosed during event creation and may vary based on ticket price, event type, and other factors.

6.3 Payment Processing

All payments are processed by Stripe, our third-party payment processor. By making a payment, you agree to Stripe's terms of service and privacy policy.

6.4 Taxes

Organizers are responsible for determining and remitting any applicable taxes related to ticket sales. Tixbud does not provide tax advice and is not responsible for tax obligations.

7. Intellectual Property

7.1 Tixbud Content

The Platform, including its design, logos, text, graphics, and software, is owned by Tixbud and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

7.2 User Content

By posting content on the Platform (including event listings, descriptions, images), you grant Tixbud a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content in connection with operating the Platform.

7.3 Copyright Infringement

If you believe content on the Platform infringes your copyright, please contact us with the following information:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement, made under penalty of perjury, that the information is accurate

8. Limitation of Liability

To the maximum extent permitted by law, Tixbud and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to:

• Your use of or inability to use the Platform
• Any events listed on the Platform
• Any transactions conducted through the Platform
• Any content posted by users or organizers
• Any technical issues, errors, or interruptions

In no event shall Tixbud's total liability exceed the amount you paid to Tixbud in the six months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Tixbud, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Your content posted on the Platform
• Any event you organize or attend through the Platform

10. Termination

Tixbud reserves the right to terminate or suspend your account and access to the Platform at any time, without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Platform will immediately cease.

11. Disclaimers

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Tixbud does not warrant that:

• The Platform will meet your requirements
• The Platform will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Platform will be accurate or reliable
• The quality of any products, services, or information obtained will meet your expectations

12. Governing Law
